Terms of Service

Welcome to Cozzle. These Terms of Service (“Terms”) are an agreement between you and Spectre Commerce LLC, doing business as Cozzle (“Cozzle,” “we,” “us,” or “our”). They govern your use of https://cozzle.co (the “Site”) and your purchase of any products from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

We have kept these Terms as readable as we could. If anything is unclear, email [email protected] and a real person will explain it.

1. Using the Site

You may use the Site only if you are at least 18 years old (or the age of majority where you live) and can form a binding contract. You agree to use the Site for lawful, personal, non-commercial purposes — in other words, to browse and shop, not to scrape, resell access, or cause trouble.

2. Your Account

You can shop as a guest or create an account. If you create an account, you are responsible for keeping your login details confidential and for all activity that happens under your account. Please give us accurate information and keep it up to date so your orders reach you. Let us know right away at [email protected] if you suspect someone else is using your account.

3. Products, Pricing, and Payment

  • All prices are in U.S. dollars and may change at any time. The price that applies to your order is the price shown at checkout when you place it.
  • Applicable sales tax and shipping charges are calculated and shown at checkout before you pay.
  • Payments are processed securely by Stripe, our payment processor. We never see or store your full card number. By placing an order you authorize the charge for your total at checkout.
  • Occasionally a product may be mispriced or described inaccurately despite our best efforts. If that affects your order, we will contact you with the option to confirm at the correct price or cancel for a full refund.
  • Product colors and textures may look slightly different on your screen than in person. We photograph everything honestly, in natural light, but screens vary.

4. Orders

Your order is an offer to buy, which we accept when we send your shipping confirmation. We may decline or cancel an order — for example, for suspected fraud, pricing errors, or stock issues — and if we do, you will not be charged, or any charge will be fully refunded. Shipping and delivery details are in our Shipping Policy, and returns are covered in our Refund and Return Policy; both are part of these Terms.

5. Wellness Disclaimer (Please Read)

Cozzle products are comfort and relaxation items made for everyday self-care and cozy moments. They are not medical devices, and they are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Any statements on the Site about our products — for example, that a product may help relieve tension, soothe tired eyes, or ease everyday stress — describe comfort and relaxation only, and have not been evaluated by the Food and Drug Administration.

If you have a medical condition, are pregnant, or have any health concerns, please talk with your doctor before using heated, weighted, cooling, or aromatherapy products. Nothing on the Site is medical advice, and our products are never a substitute for professional care.

6. Heating and Product Safety

Some of our products are designed to be warmed in a microwave. They are wonderful when used correctly — and it is your responsibility to use them correctly. Before first use, read the heating instructions included with your product, and always follow them, including:

  • Never exceed the recommended heating time or microwave power level.
  • Heat only in a clean, food-safe microwave with a rotating plate, and never leave the microwave unattended while heating.
  • Check the product’s temperature with your hands before placing it against skin — and always before giving it to a child or anyone with reduced temperature sensitivity.
  • Allow the product to cool completely before reheating.
  • Do not heat a product that is damp from cleaning, or that shows any damage, leaks, scorching, or unusual smell — stop using it and contact us.
  • Heatable and weighted products are not toys. Children should use them only with adult supervision.

We are not responsible for injury or damage caused by failing to follow the included instructions, overheating, or using a damaged product.

7. Our Content and Brand

The Cozzle name, wordmark, logo, product names, photography, text, and all other content on the Site belong to Spectre Commerce LLC or our licensors and are protected by trademark, copyright, and other laws. We are glad for you to share our pages and photos personally (tag us!), but you may not copy, modify, or use our content or brand commercially without our written permission.

8. Acceptable Use

You agree not to:

  • Use the Site for anything unlawful, fraudulent, or harmful.
  • Attempt to interfere with the Site’s security or operation, probe or test its vulnerabilities, or access data not intended for you.
  • Use bots, scrapers, or automated tools to access the Site or place orders.
  • Post or submit anything (such as a review) that is false, infringing, hateful, or impersonates someone else.

If you submit a review or other content to the Site, you give us a non-exclusive, royalty-free license to use, display, and share it in connection with the store. We may remove content that violates these Terms.

9. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms or required by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not limit the remedies in our Refund and Return Policy or any rights you have under applicable consumer-protection law that cannot be waived.

10. Limitation of Liability

To the fullest extent permitted by law, Spectre Commerce LLC and its owners, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to the Site or our products, and our total liability for any claim will not exceed the amount you paid us for the product or order giving rise to the claim. Some states do not allow certain limitations of liability, so parts of this section may not apply to you; in those states, our liability is limited to the fullest extent the law allows.

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and reasonable expenses (including attorneys’ fees) arising from your violation of these Terms or your misuse of the Site or our products.

12. Governing Law and Disputes

These Terms and any dispute arising out of them or your use of the Site are governed by the laws of the State of New Mexico, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us at [email protected] and give us 30 days to work it out informally — most things can be fixed with an email.

Disputes are resolved in the state or federal courts located in New Mexico.

13. Changes to These Terms

We may update these Terms from time to time. The version posted on this page, with its effective date, applies to your use of the Site and to orders placed after that date. If a change is significant, we will take reasonable steps to bring it to your attention.

14. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, Shipping Policy, and Refund and Return Policy, are the entire agreement between you and us regarding the Site.
